Tenspade is committed to protecting the privacy of our visitors personally identifiable information. To better protect your privacy, and so that you can understand our privacy practices, we provide this notice explaining our online information practices and the choices you can make about the way your information is used by Tenspade.


When you provide your personally identifiable information to Tenspade, you expressly accept this Privacy Policy and provide full consent to the collection, storage and processing of your personally identifiable information by Tenspade, and to the use and disclosure of your personally identifiable information to Tenspade Affiliates and third parties in accordance with the terms set out in this Policy. " Tenspade Affiliate" is any legal entity that controls, is controlled by or is under common control with Tenspade.


01. Information We Collect and How We Use It

To enable visitors to take advantage of Tenspade's services, we collect certain types of personally identifiable information from both software vendors and software buyers.


a. Software Vendors' Personally Identifiable Information

We may collect the following types of personally identifiable information from vendors to enable them to list their company and product information on our site: company name and a company contact's name, e-mail, and telephone number. In addition, we collect certain non-personally identifiable information about the vendor's company including location of headquarters and number of employees and customers.


The information that we collect from software vendors enables them to offer buyers opportunities to learn about products and services and to facilitate enterprise software transactions.


b. Software Users and Purchasers Personally Identifiable Information

We do not require visitors to register in order to do research using Tenspade 's website. However, if a visitor chooses to fill out a request for help finding software, we collect personally identifiable information including name, company name, email address, and phone number. We pass this information on to software vendors when the visitor has requested us to do so.


If a visitor fills out a review form, we collect personally identifiable information including name, company name, and email address. When a review is submitted, we pass name and company name to the software vendor. When a review is confirmed by the visitor, we display name and company name on our website. We share the visitor's email address with the software vendor upon request, on a case-by-case basis.


We also share your personally identifiable information with our Tenspade Affiliates in accordance with the terms of this Policy. In all cases, we collect, use and share your personally identifiable information in a lawful manner for relevant and appropriate business purposes. We retain your personally identifiable information only for as long as is necessary for the purposes for which it was collected.


c. Non-Personally Identifiable Information

We may collect certain non-personally identifiable information about our visitors when you visit many of our web pages such as the type of browser you are using, the type of operating system you are using, and the domain name of your Internet service provider.


We use the non-personally identifiable information that we collect to improve the design and content of our site and to enable us to personalize your Internet experience. We also may use this information in the aggregate to analyze site usage.


d. Disclosure/Legal Process

Tenspade may preserve and has the right to disclose any information about you or your use of our site without your prior permission if we have a good faith belief that such action is necessary to:

  • protect and defend the rights, property or safety of Tenspade or its employees, affiliates, other users of the site, or the public;
  • Enforce the Terms of Use or Terms and Conditions for the site. We may also disclose information as we deem necessary to satisfy any applicable law, regulation, legal process, court order, subpoena or a law enforcement agency or other governmental request.

02. Choices/Opt-Out

Tenspade and Tenspade Affiliates may contact software vendors and site visitors who have sent requests to us through forms on our website. If you prefer not to receive information from this site, just let us know by responding directly to the email.

To enhance your experience with our site, we may use cookies. Cookies are text files we place in your computer's browser to store your preferences. Cookies, by themselves, do not tell us your e-mail address or other personally identifiable information unless you choose to provide this information to us by, for example, registering at one of our sites. However, once you choose to furnish the site with personally identifiable information, this information may be linked to the data stored in the cookie.


We use cookies to understand site usage and to improve the content and offerings on our sites. For example, we may use cookies to personalize your experience at our web pages (e.g. to recognize you by name when you return to our site), save your password in password-protected areas, and enable you to use shopping carts on our sites.


Additionally, we use Google Analytics cookies to track visitor behaviour on our site. 05. Collection of Information by Third-Party Sites and Sponsors

Our site contains links to other websites (e.g., sites that provide information on specific software categories) whose information practices may be different than ours. Visitors should consult the other sites' privacy notices as we have no control over information that is submitted to, or collected by, these third parties.


We sometimes may offer promotions that are sponsored by or co-sponsored with identified third parties. By virtue of their sponsorship, these third parties may obtain personally identifiable information that visitors voluntarily submit to participate in the promotion. Tenspade has no control over the third-party sponsors' use of this information. The particular promotion will provide you with reasonable notice of the third party sponsors who will obtain such information at the time the personally identifiable information is requested.


06. Security

We use reasonable technological, physical and other measures to keep your information protected from unauthorized access. Due to the nature of the Internet and related technology, we cannot guarantee the security of your personal information and Tenspade expressly disclaims any such obligation.


07. Privacy Policy Changes

We may amend this privacy policy from time to time as we add new products and services, as we improve our current offerings, and as technologies change. If we make any material or substantive changes in our treatment of information collected at this site, we will notify you by posting a clear and conspicuous notice of these changes on our website and in this privacy policy.


08. International users

This site is hosted from India. Users located outside of India consent to the transfer of their data to India for processing and use in accordance with this privacy policy.


09. Applicable Law

Our collection and use of information as set forth in this privacy policy shall be governed by laws of India.

Terms & Conditions

01. Introduction

These Tenspade Inc. Program Terms are entered into by, as applicable, the Customer signing these Terms or any document that references these Terms or that accepts these Terms electronically ("Customer") and Tenspade Inc. ("Tenspade"). These Terms govern Customer's participation in Tenspade's program(s) and may be modified at any time. Tenspade and Customer hereby agree and acknowledge:


02. Program Participation

Customer is solely responsible for all content related to Tenspade listings and landing pages. Tenspade is not responsible for anything related to Customer's website and shall not be obligated to provide notice to Customer in the event that Customer's website is not being displayed properly to end users.


Customer shall protect any Customer passwords and takes full responsibility for Customer's own, and third party, use of any Customer accounts. Customer understands and agrees that listings may be placed on any content or property provided by Tenspade, and any other content or property provided by a third party upon which Tenspade places content or advertisements. Customer authorizes and consents to all such placements. Tenspade may modify any of its Programs at any time without liability. Tenspade also may modify these Terms at any time without liability, and Customer's use of the Program after notice that these Terms have changed constitutes Customer's acceptance of the new Terms. Tenspade or Partners may reject or remove any listings or piece of content for any or no reason.


03. Termination

Customer reserves the right to cancel the Agreement at any time without penalty. Notice of cancellation must be made by email, include a reason for cancellation and must be confirmed by Tenspade by email. Cancellation will occur within two business days of receipt of cancellation email. All outstanding fees are due immediately upon cancellation. If any outstanding fees are left unpaid, Customer agrees to pay the collections fees incurred through Tenspade's attempts to collect on the account.


04. Payment

Customer shall be responsible for all charges up to the amount of each IO, or as set in an online account, and shall pay all charges in Rupees or in such other currency as agreed to in writing by the parties. Unless agreed to by the parties in writing, Customer shall pay all charges in accordance with the payment terms in the applicable IO or Program FAQ. Late payments bear interest at the rate of 1.5% per month (or the highest rate permitted by law, if less). Charges are exclusive of taxes. Customer is responsible for paying all taxes, government charges, and reasonable expenses and attorneys fees Tenspade incurs collecting late amounts. To the fullest extent permitted by law, Customer waives all claims relating to charges (including without limitation any claims for charges based on suspected invalid clicks) unless claimed within 90 days after the charge (this does not affect Customer's credit card issuer rights). Charges are solely based on Tenspade's measurements for the applicable Program, unless otherwise agreed to in writing. To the fullest extent permitted by law, refunds (if any) are at the discretion of Tenspade. Nothing in these Terms or an IO may obligate Tenspade to extend credit to any party. Customer acknowledges and agrees that any credit card and related billing and payment information that Customer provides to Tenspade may be shared by Tenspade with companies who work on Tenspade's behalf, such as payment processors and/or credit agencies, solely for the purposes of checking credit, effecting payment to Tenspade and servicing Customer's account. Tenspade may also provide information in response to valid legal process, such as subpoenas, search warrants and court orders, or to establish or exercise its legal rights or defend against legal claims. Tenspade shall not be liable for any use or disclosure of such information by such third parties.


05. Refunds and Credits
  • Pay Per Click Program: Claims of invalid clicks are considered on a case-by-case basis. All disputes must be made within 90 days of the invoice date.
  • Pay Per Lead Program: Disputes regarding purchased leads will be considered on a case-by-case basis. Customer may dispute a lead up to 30 days from the date it was purchased.

06. Prohibited Uses

Customer shall not, and shall not authorize any party to:

  • (a) generate automated, fraudulent or otherwise invalid impressions, inquiries, conversions, clicks or other actions;
  • (b) use any automated means or form of scraping or data extraction to access, query or otherwise collect Tenspade related information from any Program website or property except as expressly permitted by Tenspade;
  • (c) advertise anything illegal or engage in any illegal or fraudulent business practice. Violation of the foregoing may result in immediate termination of this Agreement or Customer's account without notice and may subject Customer to legal penalties and consequences.

07. Confidentiality

Customer agrees not to disclose Tenspade Confidential Information without Tenspade's prior written consent. "Tenspade Confidential Information" includes without limitation:

  • (a) all Tenspade specifications, materials, guidelines and documentation relating to the Program;
  • (b) click-through rates, per-lead rates or other statistics relating to Site performance in the Program provided to Customer by Tenspade;
  • (c) any other information designated in writing by Tenspade as "Confidential" or an equivalent designation.

08. Publicity

Customer agrees that Tenspade may use Customer's name and logo in presentations, marketing materials, customer lists, financial reports and Web site listings of customers. If Customer wishes to use Tenspade's trade names, trademarks, service marks, logos, domain names and other distinctive brand features ("Brand Features"), Customer may do so, so long as such use is in compliance with this Agreement.


09. Representations and Warranties

Customer represents and warranties that:

  • (a) all of the information provided by Customer to Tenspade to enroll in the Program is correct and current;
  • (b) Customer is the owner of each Site or that Customer is legally authorized to act on behalf of the owner of such Sites for the purposes of this Agreement and the Program;
  • (c) Customer has all necessary right, power and authority to enter into this Agreement and to perform the acts required of Customer hereunder.

10. Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, TENSPADE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION FOR NONINFRINGEMENT, SATISFACTORY QUALITY, MERCHANTABILITY AND FITNESS FOR ANY PURPOSE.
